ORDER that Round Valley Unified School District's Motion to Dismiss 4 and the Motion to Dismiss by John and Julie Allen 5 are GRANTED as to Count I (Title IX) and Count II (42 U.S.C. § 1983) in their entirety, and as to punitive damage s against the Round Valley Unified School District. That the Clerk enter judgment dismissing Plaintiffs' Count I (Title IX) and Count II (42 U.S.C. § 1983) in their entirety, and their claims for punitive damages against the Round Valley U nified School District, with prejudice for failure to state a claim upon which relief can be granted. The Court expressly finds there is no just reason for delay in entry of this partial judgment and expressly directs its immediate entry.
