Filing 9 ORDER - IT IS HEREBY ORDERED that Plaintiff's Application to Proceed in District Court Without Prepaying Fees or Costs (Doc. #2 ) is granted. IT IS FURTHER ORDERED that Plaintiff may file a First Amended Complaint complying with this Order within twenty-one (21) days of the date of this Order. IT IS FURTHER ORDERED that if Plaintiff wishes to file a First Amended Complaint, Plaintiff's First Amended Complaint should include the caption and civil case number used in this Order. IT IS FURTHER ORDERED that if Plaintiff does not file a First Amended Complaint that cures all of the Complaint's deficiencies, within twenty-one days of this Order, the undersigned United States Magistrate Judge will issue a Report and Recommendation recommending that the Complaint be dismissed pursuant to 28 U.S.C. 1915(e)(2) and the accompanying motion (Doc. #3 ) be denied. IT IS FURTHER ORDERED that if Plaintiff files a First Amended Complaint, it may not be served until the Court screens the First Amended Complaint pursuant to 28 U.S.C. 1915(e)(2). IT IS FURTHER ORDERED that failure of Plaintiff to timely comply with Orders of this Court may result in the dismissal of Plaintiff's Complaint without prejudice by the District Judge.
