ORDER that the motion #6 is granted, the attorney-client privilege with regard to Mr. Jordan and Movant is deemed waived with regard to the specific claims raised in the 2255 motion #1 . Movant's pretrial and sentencing counsel David Jordan may, without violating said privilege, discuss this matter with counsel for the United States, disclose materials, and execute a declaration (if and to the extent necessary) for purposes of this 2255 litigation and only with regard to communications involving Movant's specific claims for relief. IT IS FURTHER ORDERED that any information received by Respondent pursuant to any waiver of the attorney-client privilege as found by this order shall not be disclosed beyond its usage in this habeas case and any appeal of this habeas case. Service Order (2255) - The Clerk of Court must electronically serve a copy of the 2255 Motion (Doc. #1 in CV 23-08075-PCT-GMS (CDB)) and this Order on the United States Attorney for the District of Arizona pursuant to Rule 4, Rules Governing Section 2255 Cases, and the Memorandum of Understanding between the United States District Clerk of Court for the District of Arizona and the United States Attorney's Office for the District of Arizona. Pursuant to the Memorandum of Understanding, copies of the Motion and this Order will be sent via Notice of Electronic Filing (NEF) to the Respondents through designated electronic mail addresses. The parties and the Clerk of Court must file all documents related to the 2255 Motion in the civil case. The United States Attorney for the District of Arizona or his designee has 60 days from the date of service within which to answer the 2255 Motion.
