Filing 122 ORDER denying 69 National Union's Motion for Modification of the Scheduling Order and for Leave to File a Second Amended Answer and Counterclaim; denying 84 National Union's Motion for Summary Judgment; denying 88 St. Paul' s Motion for Leave to File Sur-Reply; granting 113 St. Paul's Motion for Summary Judgment. Defendants American Home and ISP are DISMISSED from this action. National Union is obligated to reimburse St. Paul the $2 million paid and 50 % of the costs incurred by St. Paul in defending Kratos claims. St. Paul is entitled to an award of attorneys' fees, costs and prejudment interest incurred in this litigation.
