July 23, 2014	Filing 20 ORDER: IT IS ORDERED Petitioners 13 Motion to Vacate, Set Aside or Correct Sentence by a Person in Federal Custody (28 U.S.C. §2255) is scheduled for an evidentiary hearing on Petitioners ineffective assistance of counsel claim regarding the a lleged failure to file a notice of appeal, on 9/15/14 at 2:00 p.m., before Judge Cindy K. Jorgenson. Petitioners claim for ineffective assistance of counsel based on his counsels alleged misrepresentation of Petitioners exposure to incarceration if h e pled guilty pursuant to the terms of the plea agreement is DENIED. Petitioners claim for ineffective assistance of counsel based on his counsels alleged misrepresentation of Petitioners exposure to incarceration if he entered a fast track plea is D ENIED. Counsel for the government shall insure that Petitioner Catalino Solano-Rosas and CJA, Ronald Reyna, Petitioners former counsel, are present at the hearing. Counsel may submit to the Court any motions/proposed orders that will facilitate Petitioners presence at the hearing. CJA, Jose Robles is appointed to represent Petitioner at the evidentiary hearing.
