ORDER that Defendants' Motion to Compel Arbitration and Stay These Proceedings Pending Arbitration (Doc. 10 ) is DENIED to the extent that the matter must proceed to jury trial on the issue whether a valid arbitration agreement exists. It is further Ordered that Plaintiff's Motion for Partial Summary Judgment (Doc. 12 ) is DENIED. It is further Ordered that Plaintiff's Second Motion for Partial Summary Judgment (Doc. 23 ) is DENIED.
