Filing 17 ORDER ADOPTING IN PART AND REJECTING IN PART REPORT AND RECOMMENDATION 14 . The Report and Recommendation is rejected to the extent that it finds that Petitioner's claimed ineffective assistance of PCR counsel cannot serve as cause for the pro cedural default of his claims. The Report and Recommendation is otherwise adopted. It is further ORDERED that Petitioner's Petition (Doc. 1) is denied and dismissed. The Clerk of Court is directed to enter judgment as necessary and close this case. In the event Petitioner files an appeal, the Court declines to issue a certificate of appealability.
