Plaintiff William Martin's claim for breach of the covenant of good faith and fair dealing (Count Three) and claim for conversion (Count Four) are dismissed with preju dice. Plaintiff William Martins Motion to Dismiss (Doc. 20 ) is granted in part and denied in part. The Motion is granted to the extent that Defendant Weed, Inc.'s claim for fraudulent nondisclosure is dismissed without prejudice. The Motion is denied to the extent that Defendant has stated claims for fraudulent misrepresentation and fraudulent concealment. Defendant Weed, Inc.s Motion to Amend (Doc. 33 ) is granted.
