As required by the accompanying Order to the appropriate government agency, Plaintiff must pay $350 filing fee and is assessed an initial partial filing fee of $17.57. Plaintiff's 8/5/20 #6 Letter and #7 Motion to Take Judicial Notice are DENIED. Defendants Lagro, Federal Bureau of Prisons, Schneider, and Ruff are dismissed without prejudice. The following portions of the Complaint are dismissed without prejudice: the damages claim in Count One; the claim against Defendants Gallion, Schneider, and Ruff in Count Two; the Eighth Amendment damages claim regarding non-medical conditions of confinement and the First, Fifth, and Sixth Amendment claims in Count Three; and Count Four. Defendants must answer portions of the Complaint listed in this Order. As to Plaintiff's #5 Emergency Motion for Injunctive Relief: Plaintiff's request for a temporary restraining order is DENIED; the request for a preliminary injunction regarding retaliation is DENIED; the requests for counsel and class certification are DENIED. The Court will not rule at this time on Plaintiff's request for a preliminary injunction regarding pandemic-related issues.
