February 12, 2021 Opinion or Order Filing 9 ORDER FOR PAYMENT OF INMATE FILING FEE: IT IS ORDERED Cochise County Sheriff Mark J Dannels or designee must forward to the Clerk of Court the initial partial filing fee of $13.25. The balance of the $350 filing fee must be collected from Plaintiff's trust account in monthly payments of 20% of the preceding month's income credited to the account. Cochise County Sheriff Mark J Dannels or designee must notify the Clerk of Court in writing when Plaintiff is released or transferred to a correctional institution other than the Cochise County Jail. Clerk of Court must serve by mail a copy of this Order on Cochise County Sheriff Mark J Dannels, 205 North Judd Drive, Bisbee, Arizona, 85603, and to Financial Administration for the Tucson Division of the United States District Court for the District of Arizona. February 12, 2021 Opinion or Order Filing 8 ORDER: IT IS ORDERED Plaintiff's second #4 Application to Proceed In Forma Pauperis is GRANTED. As required by the accompanying Order to the appropriate government agency, Plaintiff must pay $350 filing fee and is assessed an initial partial filing fee of $13.25. Plaintiff's #3 first Application to Proceed In Forma Pauperis is DENIED as moot. The #2 Complaint is dismissed for failure to state a claim. Plaintiff has 30 days from the date this Order is filed to file a first amended complaint in compliance with this Order. Failure to comply will result in, without further notice, a judgment of dismissal of this action with prejudice that states that the dismissal may count as a "strike" under 28 USC 1915(g) and denial of any pending unrelated motions as moot. February 5, 2021 Opinion or Order Filing 1 *ORDERED: This case is severed into individual actions, one for each Plaintiff. The Clerk of Court must assign a new case number to each new individual action. The Clerk of Court must close this case (CV 20-00550-TUC-JCH) and enter judgment accordingly. The Clerk of Court must file a copy of the Complaint (Doc. 1 ) in each new case and a copy of Plaintiff Cozad's Applications to Proceed In Forma Pauperis (Docs. 2, 5 ) in the new case opened on his behalf. These documents must be deemed filed as of December 18, 2020. The Clerk of Court must mail a copy of the relevant newly filed complaint to each individual Plaintiff. Within 30 days of the date this Order is filed, Plaintiffs Jefferson, McCoy, Olson, Groom, Urrea-Moreno, Montoya, and Makowski must, in their new individual cases, either pay the $350.00 filing fee and $52.00 administrative fee or file a complete Application to Proceed In Forma Pauperis and a certified six-month trust account statement. If Plaintiffs Jefferson, McCoy, Olson, Groom, Urrea-Moreno, Montoya, and Makowski fail to either pay the $350.00 filing fee and $52.00 administrative fee or file a complete Application to Proceed In Forma Pauperis within 30 days, the Clerk of Court must enter a judgment of dismissal of the relevant action without prejudice and without further notice to Plaintiff and must deny any pending unrelated motions as moot. The Clerk of Court must mail Plaintiffs Jefferson, McCoy, Olson, Groom, Urrea-Moreno, Montoya, and Makowski a court-approved form for filing an Application to Proceed In Forma Pauperis (Non-Habeas). The individual Plaintiffs must proceed independently from this point and will not be regarded as co-plaintiffs, except upon further order of the Court. All further pleadings, motions or other papers submitted for filing by an individual Plaintiff in his separate case must be signed by the individual Plaintiff, or they will be stricken.
