February 1, 2023 Opinion or Order Filing 7 ORDER FOR PAYMENT OF INMATE FILING FEE: IT IS ORDERED, The Warden of the United States Penitentiary-Tucson or his/her designee must forward to the Clerk of Court the initial partial filing fee of $52.15. The balance of the $350.00 filing fee must be collected from Plaintiffs trust account in monthly payments of 20% of the preceding months income credited to the account. Payments must be forwarded to the Clerk of Court each time the amount in the account exceeds $10.00. The Warden of the United States Penitentiary-Tucson or his/her designee must notify the Clerk of Court in writing when Plaintiff is released or transferred to a correctional institution other than the United States Penitentiary-Tucson, so new billing arrangements may be made to collect any outstanding balance. The Clerk of Court must serve by mail a copy of this Order on the Warden of the United States Penitentiary-Tucson, U.S. Penitentiary, 9300 South Wilmot Road, Tucson, Arizona 85706. The Clerk of Court must forward a copy of this Order to Financial Administration for the Tucson Division of the United States District Court for the District of Arizona. February 1, 2023 Opinion or Order Filing 6 ORDER IT IS ORDERED: Plaintiff's Application to Proceed In Forma Pauperis (Doc. #4 ) is granted. As required by the accompanying Order to the appropriate government agency, Plaintiff must pay the $350.00 filing fee and is assessed an initial partial filing fee of $52.25. The Complaint (Doc. #1 ) is dismissed for failure to state a claim. Plaintiff has 30 days from the date this Order is filed to file a first amended complaint in compliance with this Order. If Plaintiff fails to file an amended complaint within 30 days, the Clerk of Court must, without further notice, enter a judgment of dismissal of this action with prejudice that states that the dismissal may count as a "strike" under 28 U.S.C. 1915(g) and deny any pending unrelated motions as moot. The Clerk of Court must mail Plaintiff a court-approved form for filing a civil rights complaint by a prisoner. Plaintiff's motion for appointment of counsel (Doc. #3 ) is denied.
