Filing 10 ORDER that the Plaintiff, having established in forma pauperis status in the state court, may proceed here in forma pauperis without prepayment of fees and costs or security therefor. IT IS FURTHER ORDERED that pursuant to 28 U.S.C. 1915(e)(2), the Motion to Dismiss (Doc. #7 ) is GRANTED, with leave to amend. IT IS FURTHER ORDERED that the Plaintiff may file an Amended Complaint by 1/15/2024. The Clerk of the Court is directed to DISMISS all claims and to close this case, without further notice to Plaintiff, if Plaintiff fails to file the Amended Complaint. IT IS FURTHER ORDERED that all pending motions (Docs. #5 , #8 and #9 ) are denied as moot.
