April 10, 2020 Opinion or Order Filing 768 MINUTES OF IN CHAMBERS - ORDER EXTENDING TEMPORARY RESTRAINING ORDER AND PERMITTING SUPPLEMENTAL BRIEFING by Judge Dolly M. Gee: Because Defendants Immigration and Customs Enforcement ("ICE") and Office of Refugee Resettlement's (" ;ORR") recent data disclosure has brought to light new, more particularized issues not previously raised in Plaintiffs' Temporary Restraining Order ("TRO") or Defendants' Opposition, Defendants request the opportunity to file a Second Supplemental Opposition 762 . The Court agrees that permitting Defendants to respond would create a more complete record before it rules on Plaintiffs' request for preliminary injunction. Accordingly, Defendants' request is GRANT ED. In their Second Supplemental Opposition, Defendants shall address Plaintiffs' supplemental declarations about conditions at the Family Residential Centers ("FRCs") and questions discussed in this order. Pursuant to Federal Rule of Civil Procedure 65(b)(2), the Court therefore EXTENDS, for a period of 14 days, the following aspects of the 3/28/2020 TRO 740 : Defendants are ORDERED TO SHOW CAUSE by 4/24/2020 at 10:00 AM why a preliminary injunction should not issue, etc. Pendin g the OSC hearing, IT IS HEREBY FURTHER ORDERED that: (a) ORR and ICE shall make every effort to promptly and safely release Class Members; (b) By 4/17/2020, Defendants may file a Second Supplemental Response to Plaintiffs' supplemental declarat ions about conditions at the FRCs and the questions in this order. Plaintiffs may file their reply to Defendants' Second Supplemental Response by 4/22/2020; (c) The Independent Monitor, Andrea Ordin, may in the exercise of her monitoring duties request such further information regarding Defendants' continuous efforts at release as she deems appropriate; (d) The Juvenile Coordinators shall continue to monitor those facilities where compliance with CDC guidelines may be lacking or incomp lete; (e) The parties' counsel shall meet and confer regarding certain disclosures and the quality of the data the Defendants provide to Class Counsel. By no later than 4/23/2020 at noon, the parties shall file a Joint Status Report regarding th e outcome of their efforts to meet and confer. The Court shall hold a further videoconference on Plaintiffs' Motion for Preliminary Injunction on 4/24/2020 10:00 AM before Judge Dolly M. Gee. September 27, 2019 Opinion or Order Filing 690 PERMANENT INJUNCTION by Judge Dolly M. Gee. On September 27, 2019, the Court entered an Order granting Plaintiffs' Motion to Enforce and denied Defendants Motion to Terminate the Flores Settlement Agreement 688 . Accordingly, IT IS HEREBY OR DERED as follows: 1. The Flores Settlement Agreement remains in effect and has not been terminated; 2. Because the regulations, published on August 23, 2019, entitled "Apprehension, Processing, Care, and Custody of Alien Minors and Unaccompanied Children," 84 Fed. Reg. 4493244,535 ("the New Regulations"), fail to implement and are inconsistent with the relevant and substantive terms of the Flores Settlement Agreement, including Paragraphs 9 and 40 of the Agreement, Defendant s shall continue to comply with the Flores Settlement Agreement until they publish final regulations in compliance with the Agreement, including Paragraphs 9 and 40; and 3. Defendants are permanently enjoined from applying, implementing, or enforcing the New Regulations. (kti)
