September 15, 2005 Opinion or Order Filing 330 ORDER by Judge Margaret M. Morrow : granting 322 MOTION for final approval of a distribution plan and authorization for final payment of fees and costs related to distribution of the class settlement funds: THe Court adopts Judge Altman's distribution plan to the extent not inconsistent with this order. The Court finds that Lee Minshull is not a member of the clase, and therefore lacks standing to object either to approval of the class settlement or distribution of the fund it created. The Court also finds the the Trustee is not a class membetr to th eextent he seeks to recover for net creditor claims that were not filed in the bankruptcy proceeding as of the date a class was certified. As respects the amount of the settlement fund tht is attributable to the unresolved claims of James William Firman-IRA, Peter Rakow, Karen Rakow, and Irwin Zalcverg, the court directs that the Trustee hold the funds for the benefit of claimants pending resolution of their claims in the bankrupecy court. If any of these creditors' claims is ultimately allowed, the holder of the claim is entitled to a distribution from the settlement fund that reflects the 85%, 45%, 5.52% distribution ratio recommended by Judge Altman and adopted herein. If any of the claims is disallowed, the distribution that the creditor would have received must be distributed proportionally to members of the class. Finally, the court approves the payment of fees and costs to Gilardi in the amount $23,053.79, and to Caldwell Leslie in the amount of $11,604.43.
