See Davis v. Estate of Salvatore Bonanno, CV09-1771-JAT (D. Ariz.), Docket Nos. 41 and 42. Therefore, The Court DENIES AS MOOT Motion to hold Defendant in contempt 336 . The Court will not welcome repeated efforts by either party to require the Court to exercise further jurisdiction over this matter. (jp)

Howard Matz re Minutes of In Chambers Order 282 : The Court has prepared the attached draft ruling on Plaintiffs motion for holding Defendant BJ Davis in contempt. Given the apparent severe adverse i mpact to the plaintiff of the defendants conduct that triggered the motion, it is imperative that the rights of the parties as to this contempt citation be determined on a prompt and timely basis. Accordingly, this Court will hold a hearing on the ma tter on August 17, 2009 at10:00 a.m. The Court is aware that Mr. Davis has claimed unavailability, not only on that date, but through October 15, 2009. The Court cannot credit that claim, given Mr. Daviss previous game-playing, as reflected in prior court rulings. Mr. Davis is invited to attend the August 17 hearing and provide at that time any admissible evidence or argument why the attached order should not be made final. (se)

Howard Matz: The Court DENIES Defendants EX PARTE APPLICATION for Order Vacating Final Judgment on Consent 241 , 242 , 243 , 244 . on procedural grounds and on the merits. Defendant has not established any r easons for proceeding ex parte rather than by way of noticed motion. On the merits, Defendant has not established that the consent judgment is void ab initio by virtue of the Courts having inserted a jurisdictional provision into the proposed consent judgment prior to approving it. Nor has Defendant demonstrated that Plaintiff has breached the parties' settlement agreement that was incorporated into the consent judgment. (jp)
