April 22, 2010 Opinion or Order Filing 40 MINUTES (IN CHAMBERS) by Judge Christina A. Snyder: After carefully considering the arguments set forth by both parties, the Court finds and concludes as follows as to Defendant City of Los Angeles' Motion to Dismiss, or in the Alternative, Moti on to Stay Case Based on Pullman Abstention Doctrine 31 . The Court GRANTS in part defendant's motion to dismiss and dismisses without prejudice plaintiffs' claim (1) for relief. The Court DENIES defendant's motion to dismiss plaintif fs' remaining claims as moot because the Court GRANTS defendant's motion to stay the instant action pending resolution of the similar proceeding in the Los Angeles County Superior Court. The case shall be removed from the Court's active case list, and the parties shall file a joint status report advising the Court of the status of the state action every 120 days.
