Filing 48 JUDGMENT ON SECOND AMENDED COMPLAINT For (1) Equitable Subrogation and (2) Quiet Title by Judge Manuel L. Real: The Court having considered the Stipulation for Entry of Judgment 47 executed by the appearing parties to this action, now enters Judgm ent in this action as follows: The Deed of Trust on the real property in Northridge, CA is declared equitably subrogated in the prinicipal amount $487,088.80 to a Senior First Lien Position. To said prinicipal amount of $487,088.80, plainti ff is further entitled to add interest, attorneys' fees in the amount of $47,408.25, and costs of $981.70. The remaining principal balance of $105,411.20 which was funded under the Deed of Trust, but which did not pay off then exi sting senior liens, shall remain an equitable lien against the subject property. Title to the subject property is hereby quieted as follows: a) In First Lien Position: Indymac Bank in the principal sum of $487,088.80 plus interest, costs and att orneys fees. b) In Second Lien Position: Tax Liens of the Department of the Treasury to United States of America. c) In Third Lien Position: an equitable lien in favor of Indymac Bank in the sum of $105,411.20. d) In Fourth Lien Position: the WAMU home equity line secured by the Deed of Trust.
