DISMISSAL BY COURT FOR LACK OF SUBJECT MATTER JURISDICTION by Judge Philip S. Gutierrez: On September 25, 2008, the Court issued a second Order to Show Cause for Lack of Subject Matter Jurisdiction 20 . On October 17, 2008, Plaintiff filed a second amended complaint 22 . However, Plaintiffs second amended complaint failed to alleged facts establishing that this court has subject matter jurisdiction. Accordingly, it is hereby ORDERED and ADJUDGED that the aboveentitled action be dismissed in its entirety for failure to prosecute. (ir)
