April 11, 2011 Opinion or Order Filing 131 MINUTE: ORDER Re: DISMISSAL WITHOUT PREJUDICE (In Chambers): On March 31, 2011, the Court ordered Plaintiffs Sky Tag, Inc., et al. to show cause why this caseshould not be dismissed in light of the decision in World Wide Rush, LLC v. City of Los Angeles, 606 F.3d 676 (9th Cir. 2010). Plaintiffs responded on April 11, 2011, indicating that they have elected not to pursuing any remaining commercial speech claim after World Wide Rush and conceded that no otherviable claims remain in this case following the World Wide Rush decision. As a result, Plaintiff did not object to the Court dismissing this case, although they ask for dismissal without prejudice since the remaining commercial speech claim has never been litigated. Therefore, the Court DISMISSES this case WITHOUT PREJUDICE IT IS SO ORDERED by Judge Audrey B. Collins. (Made JS-6. Case Terminated.) (ir)

March 31, 2011 Opinion or Order Filing 129 MINUTES (IN CHAMBERS) ORDER TO SHOW CAUSE Why Cases Should Not Be Dismissed; ORDER Denying WITHOUT PREJUDICE Pending Motions by Judge Audrey B. Collins denying #94 Motion for Summary Judgment; denying #100 Ex Parte Application to Strike ; denying #101 Ex Parte Application: The Ninth Circuit reversed the grant of summary judgment in favor of the Plaintiffs in the related case World Wide Rush, LLC v. City of Los Angeles, 606 F.3d 676 (9th Cir. 2010). Plaintiffs in these related cases were also part of that appeal. Id. at 680. Plaintiffs informed the Court that they believed their commercial speech claims remained after World Wide Rush, but they would notify the Court of the status of these cases once the time to seek review in the Supreme Court expired. That time has expired and nothing has been filed. Plaintiffs are ORDERED TO SHOW CAUSE within 10 days of the date of this Order why these cases should not be dismissed following the Ninth Circuit's mandate in World Wide Rush. Failure to timely respond will result in dismissal of these cases without further notification to the parties. The Court also notes that several motions remain outstanding on the dockets in these two cases, namely: Docket Nos. 142, 162, 163, 169, 170, 175, 176, and 177 in the Jamison matter, all of which relate to a motion for summary judgment filed by Plaintiffs in that case; and Docket Nos. 94, 100, and 101 in the Sky Tag matter. September 27, 2010 Opinion or Order Filing 126 MINUTE ORDER IN CHAMBERS RE: Status Conference by Judge Audrey B. Collins: The Court held a status conference in the above-captioned cases on September 27, 2010. The Court orders as follows. All parties should have read the Court's Order denying the preliminary injunction in Vanguard Outdoor, LLC v. City of Los Angeles, CV 08-6035, amended on September 27, 2010. For the lead case that has been remanded, World Wide Rush v. City of Los Angeles, CV 07-238, any request to amend Plaintiff's complaint will likely be denied because the Ninth Circuit affirmed the Court's refusal to allow further amendments to the complaint in this case. The Court is willing to wait until the time for Supreme Court review has expired or review is denied before dismissing this case. The parties in the related World Wide Rush v. City of Los Angeles, CV 09-3793, noted that this case will also be dismissed based upon the outcome of Supreme Court review. In Paramount Contractors & Developers, Inc. v. City of Los Angeles, CV 08-5653, the Court issued a minute order on September 24, 2010, denying as moot the City's pending motion to dismiss (filed in October 2008) and gave Plaintiff until October 26, 2010, to file an amended complaint. In Vanguard Outdoor, LLC v. City of Los Angeles, CV 08-6035, the plaintiff was permitted to file its amended complaint without leave of Court, per the Court's Order on September 24, 2010 in that case. For all other cases, the main issue seems to be a Central Hudson challenge to the offsite and supergraphic sign bans (although there may be a few other claims in specific cases). For any plaintiff that has indicated in its joint status report that it would like to file an amended complaint, leave of Court must be obtained via regularly noticed motion, to be filed no later than Monday, November 2, 2010, unless the parties can stipulate to the filing of the amended complaint before that date. If a motion to amend is filed (or contemplated), the City is to wait for the Court to rule on the motion before filing a motion to dismiss in the same case. If the motion to amend is granted, the City may then file a motion attacking the amended pleading. In cases in which the plaintiff has indicated it will not seek leave to amend or the parties stipulate to the filing of an amended complaint, the City may want to file motions to resolve these cases. To the extent possible, the City should meet and confer with counsel for the plaintiffs in these cases to determine the most efficient approach, whether by a consolidated "master" motion filed in multiple cases or individual motions in each case. If individual motions are the more prudent approach, the City should not notice them all for the same hearing date. Finally, the parties in Figueroa Project 2, LLC v. City of Los Angeles, CV 08-5066 and CV 08-8508 agreed that these cases should be consolidated and would file a stipulation to that effect, but nothing has been filed. The parties are ORDERED to do so no later than Monday, October 18, 2010. (bm)

July 30, 2010 Opinion or Order Filing 120 MINUTES: ORDER RE: REQUEST FOR OSC RE DISMISSAL AND STATUS CONFERENCE (In Chambers): First, the Court ORDERS that, except in CV 08-7854 and CV 08-6035, any stay imposed in the above cases be LIFTED. Second, the Court ORDERS the parties in each action to meet and confer and the file a detailed joint status report in each case no later than Tuesday, August 24, 2010, setting forth their respective positions on the impact of the decision in World Wide Rush and what claims remain in each pending case, if any. The Court declines to set any status conferences until it has had an opportunity to review the parties reports. The City has requested that the Court immediately lift the injunction issued in favor of Plaintiff Community Redevelopment Agency in CV 08-7854 and the stay of enforcement in favor of Plaintiff Vanguard Outdoor, LLC in CV 08-6035, which were explicitly based upon the injunction vacated in World Wide Rush. Plaintiff Community Redevelopment Agency and Plaintiff Vanguard Outdoor, LLC are ORDERED TO SHOW CAUSE no later than August 24, 2010 why the injunction and stay of enforcement should not be lifted in light of World Wide Rush. The City may reply to each Plaintiffs response no later than August 31, 2010. The Court recognizes that Plaintiffs World Wide Rush, Jamison, and Sky Tag are contemplating petitioning to the United States Supreme Court for review of the World Wide Rush decision and moving to recall the mandate issued by the Ninth Circuit while that petition is pending. Collins: The WWR Plaintiffs' motion for contempt (WWR Docket No. 208), the motion is GRANTED IN PART AND DENIED IN PART. The Court FINDS clear and convincing evidence that the City is in contempt of the World Wide Rush Injunction. The Court ORDERS the City to discharge the citations for 12.21.A.1.(a), 14.4.16, 91.6201.2, and 91.6201.4 as to the 10801 National location within 10 days of this order. Furthermore, the Court ORDERS the City to discharge the citation under 14.4.10 as to the sign on the North wall at the 10801 National location within 10 days of this order. The Court also ORDERS the City (and Fire Department) to discharge the citation for California Code of Regulations 108.4.1 as to the 5150 Wilshire location within 10 days of this order. As a sanction, the Court AWARDS the WWR Plaintiffs the fees and costs incurred in bringing their ex parte application (Docket No. 205) and this motion (Docket Nos. 208 et seq.). The Court ORDERS the WWR Plaintiffs to submit an accounting to the City within 30 days of this order. The City should make payment to the WWR Plaintiffs within 40 days of this order. If the City objects to the amount, and the WWR Plaintiffs are not able to reach agreement with the City on the appropriate recovery, the City can withhold payment and the parties should stipulate to, and submit to the Court, within 40 days of this order, a briefing schedule for resolution of the issue. As to the remaining fire safety citations, the Court ORDERS the City to notify the WWR Plaintiffs, within 10 days of this order, as to how they can appeal the citations and/or meet the Fire Department's concerns. Lastly, the Court ORDERS the City and Fire Department to file a report with the Court, within 60 days of this order, as to how many Supergraphic Signs in the Hollywood SUD still cover windows and how many of those signs have been cited for fire safety violations. As to the Jamison-Sky Tag Plaintiffs' motion for a preliminary injunction (Jamison Docket No. 71), the motion is DENIED. As to the 85 locations misrepresented by McNeilly, the motion is DENIED WITH PREJUDICE. As to the remaining 33 locations, the motion is DENIED WITHOUT PREJUDICE as the Court lacks sufficient information to rule as to those locations. If the Jamison-Sky Tag Plaintiffs continue to seek relief as to these 33 locations, they should file a brief within seven days of this order identifying the signs at the 33 locations and the need for injunctive relief as to those signs. The City may file an opposition brief within 14 days of this order and the Jamison Sky-Tag Plaintiffs may file a reply brief within 21 days of this order. As to Liberty's motion to amend (CRA Docket No. 33) the injunction in that matter, the motion is DENIED. Likewise, the City's motion for reconsideration (CRA Docket No. 32) is DENIED. As to Figueroa's motions to stay (CV 08-08508 (Docket No. 12); CV 08-05066 (Docket No. 16)), the motions are GRANTED.
