Because the Court's analysis is dispositive of Plaintiff's claims against the individual employees, Yahoo, and Expedia as well, the First Amended Complaint 45 is dismi ssed in its entirety. Plaintiff may file a second amended complaint (SAC) within 21 days of the date of this order. MINUTES OF IN CHAMBERS ORDER held before Judge Philip S. Gutierrez: Before this Court are Delta Airlines, Inc.'s motion to dismiss and motion for partial summary judgment, as well as Yahoo!, Inc.'s motion to dismiss. The Court finds the ma tters appropriate for decision without oral argument. Fed. R. Civ. P. 78; Local R. 7-15. After considering the moving and opposing papers, the Court hereby GRANTS the motions. Yahoo and Delta's motions to dismiss the RICO claim are GRANTED, wi th leave to amend. Delta's motion for summary judgment on Plaintiff's breach of contract claim is GRANTED. Plaintiff may file an amended complaint by February 13, 2009. If Plaintiff fails to file an amended complaint within the deadline, the action will be dismissed with prejudice as to defendants Delta and Yahoo. 11 , 12 , 19 , 28 . (wm)
