Filing 19 CONSENT DECREE AND PERMANENT INJUNCTION by Judge George H. King: Having read and considered the Joint Stipulation for Order 18 . This Court has jurisdiction over the parties to this action and over the subject matter. Plaintiff claims that it owns o r controls the pertinent rights in and to thecopyright registrations listed in Exhibit A attached hereto and incorporated herein by this reference (The copyrights identified in Exhibit A are collectively referred to herein as Plaintiffs Properties). Plaintiff has alleged that Defendant has made unauthorized uses of Plaintiffs Properties or substantially similar likenesses or colorable imitations thereof. Defendant and his agents, servants, employees and all persons in active concert and particip ation with him who receive actual notice of the Injunction are herebyrestrained and enjoined. Each side shall bear its own fees and costs of suit.Except as provided herein, all claims alleged in the Complaint as to Defendantare dismissed with prejudi ce. This Injunction shall be deemed to have been served upon Defendant at the time of its execution by the Court. The Court finds there is no just reason for delay in entering this Injunction and,pursuant to Rule 54(a) of the Federal Rules of Civil P rocedure, the Court directs immediate entry of this Injunction against Defendant. The Court shall retain jurisdiction of this action to entertain such further proceedings and to enter such further orders as may be necessary or appropriate to implement and enforce the provisions of this Injunction. The above-captioned action, shall, upon filing by Plaintiff of the Settlement Agreement, Stipulation for Entry of Judgment and Judgment Pursuant to Stipulation. (ir) |
Filing 17 CONSENT DECREE AND PERMANENT INJUNCTION filed by Judge George H. King against Yau Han a/k/a Yauchoong Han a/k/a Aelvin Han. The Court hereby Orders that based on the parties' Stipulation 15 and only as to Defendant Yau Han, this injunction i s hereby entered as follows: (see document for further details). Each side shall bear its own fees and costs of suit. Except as provided herein, all claims alleged in the Complaint as to Defendant are dismissed with prejudice. The claims alleged in the Complaint as to the remaining defendants Wai Kuan Tan a/k/a Tan Wai Kuan and Edmond Wong remain active, and this Court shall retain jurisdiction over them. (mg) |
