ORDER RE DISMISSAL WITHOUT PREJUDICE OF SECOND CAUSE OF ACTION by Judge Percy Anderson: Upon Stipulation #13 , IT IS HEREBY ORDERED: (1) County Ordinance No. 4701 does not authorize the County to rely on any releases or violations that occurred prior to the Ordinance's effective date of 1/8/2009 in making the determination of "High Risk Operation" under Section 254 of the Ordinance or "High Risk Operator" under Section 2543(e) of the Ordinance. (2) The Second Cause of Action against the County is dismissed without prejudice. (3) The County's 12(b)(6) Motion #11 will proceed on all other grounds stated other than the arguments directed to the Second Cause of Action. (4) This Order shall not constitute a result in Greka's favor to support an award of attorneys' fees or costs on any ground including, but not limited to, 42 U.S.C. Sections 1983 or 1988. (gk)
