Snyder: The Court finds Defendants' Motion to Dismiss Complaint for Failure to State a Claim (FRCP 12(B)(6); Request for Entry of Order Pursuant to Civ LR 83-8 12 appropriate for decision without ora l argument. Accordingly, the hearing date of 9/28/2009, is hereby vacated, and the matter is hereby taken under submission. Having filed approximately 28 complaints in the district, plaintiff Amanda U. Ajuluchuku-Levy was declared a vexatious litigan t in the Central District of California on 9/8/2009 by Judge Dale S. Fischer. Accordingly, this Court issued an order stating that plaintiff may proceed against any defendant in this action on the filing of security in the amount of $5,000 by 9/29/2009. On 9/14/2009, plaintiff responded that she cannot post the required security. Accordingly, for good cause the Court dismisses plaintiff's complaint without prejudice. ( MD JS-6.
