JUDGMENT by Judge A. Howard Matz: On 1/4/2010, the Court granted Defendants Motion to Dismiss Plaintiff complaint. The Court further allowed Plaintiff 15 days to file an amended complaint to cure the defects in the first complaint. To ddate, Plaintif f has not filed an amended Complaint. AS PLAINTIFF has failed to amend his Complaint withint the time allowed by the Court, and for the reasons explained in Defendants MOTION to Dismiss 8 , the Court hereby DISMISSES the Case. MINUTES OF IN CHAMBERS ORDER held before Judge A. Howard Matz: On October 8, 2009, Plaintiff Charles Manzanares filed a motion for a Temporary Restraining Order (TRO) to stop Defendant Quality Loan Service Corp. from foreclosing on his residence. The motion was filed with the Court at 4:10 p.m. on October 8, 2009, after the foreclosure had evidently been completed at 10:30 a.m. thatday, according to the moving papers. On that basis, the motion for the TRO was moot when received, and is DENIED as moot. Moreover, the service of the motion on Defendants appears to be inadequate, and the motion for the TRO is DENIED on that basis, as well. (se)
