Bagley, and (2) that Plaintiff Richard D. Bagley is awarded judgment for, and shall recover such overpayment of tax against Defendant United States of America, together with interest as permitted by 26 U.S.C. 9 Section 6611 and 28 U.S.C. Section 2411, at the rate set forth in 26 U.S.C. Section 6621. (lom)

Accordingly, the court concludes that (a) Bagley was engaged in the trade or business, within the meaning of Section 162(a), of prosecuting a FCA lawsuit against TRW, (b) Bag ley incurred and paid necessary and ordinary business expenses in the amount of $18,477,815 related to that trade or business, and (c) Bagley is entitled to a refund of federal income taxes paid in the amount of $3,874,407 plus interest as allowed by law, with regard to his 2003 tax year.
