MINUTES (IN CHAMBERS): Order GRANTING Defendant's Motion to strike class action allegations by Judge Philip S. Gutierrez:Before the Court is Defendant Creditors Interchange Receivable Management, LLC's ("CIRM" or "Defendant&q uot;) motion to strike class action allegations from Plaintiff Rejean Fournier's ("Plaintiff") Complaint on grounds that Plaintiff failed to timely file a motion for class certification in compliance with Local Rule 23-3. The Court fin ds the matter appropriate for decision without oral argument. See Fed. R. Civ. P. 78; L.R. 7-15. Having considered the papers submitted in support of and in opposition to Defendants motion, the Court GRANTS the motion.
