MINUTES (IN CHAMBERS) by Judge Christina A. Snyder: The Court GRANTS Defendants Kerzner International North America, Inc. ("KINA") and Kerzner International Resorts, Inc.'s ("KIRI") Motion to Dismiss Plaintiff's First Am ended Complaint 9 . In light of the Court's dismissal based on its finding that the forum selection clause is valid and enforceable, the Court declines to address defendants' 12(b)(6) motion to dismiss for failure to state a claim on the grounds that KINA and KIRI are improper parties to this lawsuit or defendants' 12(b)(2) motion to dismiss for lack of personal jurisdiction.
