ORDER by Judge Otis D Wright, II: Defendants' Motion for Summary Judgment, or in the alternative Partial Summary Judgment 27 GRANTED IN PART and DENIED IN PART. Specifically, the Court grants Defendants' Motion as to Plaintiffs § 198 3 claims for false arrest and malicious prosecution, Plaintiffs second claim under Monell, Plaintiff's fourth claim for false arrest, and Plaintiff's fifth "torts in essence" claim. These claims are hereby dismissed. Defendants' Motion is denied as to Plaintiff's remaining claims. (ir)
