MINUTES (IN CHAMBERS) ORDER by Judge Philip S. Gutierrez granting 10 Defendant's Motion to Dismiss: Based on the foregoing, the Court GRANTS Defendants motion to dismiss Plaintiffs' Complaint as to Bank of America, N.A. in its entirety WI TH LEAVE TO AMEND, and GRANTS Defendants' motion to dismiss Plaintiffs Complaint as to MERS according to the following: (1) California Corporation Code § 2105 claimdismissed with prejudice. (2) California Unfair Competition Law claimdismiss ed with leave to amend. Plaintiff has until FEBRUARY 7, 2011 to file a Second Amended Complaint to state an actionable state or federal law claim.
