Defendant Motion is DENIED as to claim two, and GRANTED as to the remaining claims. Plaintiff may file an amended complaint on claims three, four, five, seven, and ten. Claims one, six, eight, and nine are dismissed with prejudice. The amended complaint must be filed by not later than 1/24/2011. Defendant Motion to Strike [ 6] is DENIED as moot. As to their mortgage default, Plaintiff is advised to look into whether she may be entitled to some relief under Wells Fargo Bank recent agreement with the California Attorney General concerning "pick-a-payment borrowers" whose homes or properties were foreclosed.
