September 28, 2011 Opinion or Order Filing 59 ORDER by Judge Ronald S.W. Lew, re Plaintiff Nano-Second Technology's ("Plaintiff") Motion for Preliminary Injunction Against Defendant Dynaflex International ("Defendant") 18 . The Court DENIES Plaintiff's Motion for P reliminary Injunction as it pertains to the sale of Plaintiff-manufactured products. Amazon.com, Inc v. Barnesandnoble.com, Inc., 239 F.3d 1343, 1350 (Fed.Cir. 2001)("[M]ovant cannot be granted a preliminary injunction unless it establishes both of the first two factors," which are the likelihood of success on the merits and irreparable harm). For Defendant-manufactured products, all four factors point toward a denial of a preliminary injunction. As such, the Court finds that a prelimi nary injunction is not appropriate and DENIES Plaintiff's Motion for Preliminary Injunction to enjoin Defendant's sale of Defendant-manufactured products. Accordingly, the Court DENIES Plaintiff's Motion for Preliminary Injunction in its entirety. (Refer to attached document for details.) (lom)
