King: On February 17, 2012, we issued our Order Modifying Scheduling Dates in which we set scheduling dates that, to some extent, differed from those set by Judge Valerie Baker Fairbank. In doing so, we had fully considered the parties' Joint Stipulation to Continue Dates Set Forth in Scheduling and Case Management Order filed on December 19, 2011 (Doc. # 100), but declined to fully adopt the parties' suggestions. Today, we received the parties' Revised Joint Stipulation [etc.] that was filed on February 17, 2012 (Doc. # 138) which we did not see until today. In light of Defendant counsel's medical emergency, we now grant the parties the requested 2-week extension re: briefing on the pending Motion for Class Certification. We decline to grant any further modifications to our February 17, 2012 scheduling order at this time inasmuch as any such request is speculative, at best, given the lack of sufficient information as to counsel's estimated time for recovery. While we are highly sympathetic of counsel's unfortunate condition, we also cannot blindly approve dates that do not have any known relationship with the time it might take counsel to recover. Moreover, while we certainly hope for counsel's speedy and complete recovery, Defendant has an affirmative duty to ensure that counsel's law firm takes the necessary steps to ensure the timely resolution of this action. Filing 141 MINUTE ORDER (IN CHAMBERS) ORDER MODIFYING SCHEDULING DATES by Judge George H. King: This matter was transferred to us from Judge Valerie Baker Fairbank. Previously, Judge Fairbank had setcertain scheduling dates, including the date for the filing of any motion for class certification. Plaintiff has filed said motion. Accordingly, we will hear that motion as it is currently calendared. However, as to the other scheduling dates in Judge Fairbanks scheduling order, they are VACATED to the extent that they conflict with this Scheduling Order. We have also considered the parties' Joint Stipulation to Continue Dates Set Forth inScheduling and Case Management Order filed on December 19, 2011 (Doc. # 100), but do not adopt entirely those stipulated dates. Instead, we now issue this Scheduling Order which shall henceforth control the progress of this case. Counsel shall carefully review this Order as it differs from Judge Fairbank's Order in many material aspects.....1. All fact discovery shall be COMPLETED by no later than August 13, 2012....2. The parties shall designate their expert witnesses, if any, and make the required disclosures by no later than August 13, 2012, and do likewise for any rebuttal expert witnesses by no later than September 13, 2012. 3. All expert discovery shall be COMPLETED by no later than November 1, 2012. 4. The parties shall comply with Local Rule 16-15 by no later than November 12, 2012. If the case settles, counsel shall notify the court clerk forthwith. If the case does not settle, counsel shall file a joint status report with the court within 48 hours of termination of settlement discussions. 5. No motion for summary judgment may be filed without a joint certification by counsel that they have complied in good faith with Local Rule 16-15 as set forth above.
