Filing 328 JUDGMENT by Judge Dean D. Pregerson. The Court GRANTS the Parties request for Final Approval of Class Action settlement. The Court finds that: (1) the settlement amount of $600,000 is fair and reasonable to the Class members. The Court further f inds that Class Counsels requested fees award of $200,000 (the Fee Award), which equals 33.33% of the Gross Settlement Amount, is reasonable. The Court approves Class Counsels request for recovery of $146,000in actual costs and expens es in prosecuting this Action and finds that said costs and expenses were reasonably incurred in the prosecution of this case. The Court approves the payment of the total Incentive Award of $24,000 with $3,000.00 payable to each of the Lead Plaintiffs, David Ribot, Anthony Butler, Jennifer Butler, Rita Dunken, Deborah Mills, Lois Barnes, Jonathan Luna, and Perry Hall, Jr. These payments are in addition to their individual settlement payments. The Court approves the payment of $29, 986 to Rust Consulting, as theappointed Settlement Administrator for the purpose of the Settlement, forreasonable administration costs incurred and to be incurred to conclude theadministration of this settlement. Filing 278 ORDER RE DEFENDANTS MOTION TO DENY CERTIFICATION AS TO 21ST CENTURY CLASS, PLAINTIFFS MOTION FOR RELIEF UNDER RULES 26 AND 37, AND PLAINTIFFS MOTION TO MODIFY SCHEDULING ORDER 268 by Judge Dean D. Pregerson: On February 24, 2014, Plaintiffs filed the instant Motion for Relief Under Rules 26 and 37.1 (Dkt. No. 260.) Plaintiffs contend that the court should not consider the releases on various grounds relating to the timeliness and completeness of Defendants discovery productions. Having consid ered the parties arguments, the court concludes that the matter of the releases is best addressed on a motion for summary judgment, prior to resolving the question of class certification for the 21st Century employees. Accordingly, Defendants are ord ered to file a motion for summary judgment by April 29, 2014. Plaintiffs Opposition must be filed by May 6, 2014. Defendants must file any Reply by May 13, 2014. The Motion shall be calendared for Monday, June 2, 2014 at 10:00 am.As to Plaintiffs Mot ion to Modify Scheduling Order 268 , the court grants in part and denies in part the Motion as follows:(1) Fact discovery is closed.(2) All other dates set in the courts August 8, 2013 Scheduling Order (Dkt. No. 228) are vacated. A status conference regarding trial dates is set for June 30, 2014 at 2:30 p.m. The parties are ordered to meet and confer in advance of the status conference to develop proposed dates for a modified Scheduling Order. With respect to class lists, the courts December 2, 2014 Order to Extend Deadline to Produce Class Lists (Dkt. No. 225) is modified as follows: Defendants shall produce class lists for all class members, excluding putative class members from the Woodland Hills 21st Century facility, by May 7, 2014.Wi th respect to class notice, once the court has ruled on the forthcoming motion for summary judgment and the pending motions concerning the inclusion of the Woodland Hills 21st Century employees among the certified classes, the parties shall submit a revised proposed Notice of Class Action and Collective Action for the courts approval.
