The Court hears from counsel for plaintiff, who states he has settled the matter with defendants Legacy Group Recovery Inc and Tom Fallon, each of whom filed answers to the complaint on May 3, 2011, and this is why the parties have failed to file a Joint Report of Early Meeting of Counsel. The Court ORDERS the action dismissed as to defendants Legacy Group Recovery and Tom Fallon pursuant to the settlement as stated by counsel for plaintiff. The Court FURTHER ORDERS that this action is also dismissed as to the remaining defendant Revenue Recovery Systems LLC, without prejudice, for lack of prosecution, as this defendant hasnot answered the complaint and plaintiff has made no attempt to obtain entry of default of this defendant, although service was purportedly made on them on April 28, 2011.
