Filing 13 ORDER by Judge Ronald S.W. Lew. Defendant Management Information Technology Corporation's Motion to Dismiss for Improper Forum is GRANTED IN PART AND DENIED IN PART 14 . The Court finds that Plaintiff has failed to meet its burden to establish that enforcing the forum selection clause would deprive Plaintiff of its day in court or contravene any strong California public policy. Accordingly, the Court finds that the forum selection clause is valid and enforceable. As such, the Court GRANT S Defendant's Motion to Dismiss this Action for Improper Venue pursuant to Federal Rule of Civil Procedure 12(b)(3). The Court DENIES Defendant's request for attorneys' fees.
