Filing 20 MINUTES (IN CHAMBERS) Nunc Pro Tunc Order Amending 5/7/2012 Order by Judge Christina A. Snyder: In an order dated 5/7/2012, this Court granted the government's motion to dismiss plaintiffs complaint 19 . However, having determined that it lacke d jurisdiction vacate the Temporary Restraining Order issued by the Los Angeles Superior Court 15 , the Court directed the government to move the Superior Court for such relief. Upon further review, the Court finds that this determination was in err or, and that the Court in fact has jurisdiction to vacate the Temporary Restraining Order because this case was removed to this Court. Accordingly, the Court amends its 5/7/2012 order nunc pro tunc, and hereby VACATES the Temporary Restraining Order issued by the Los Angeles Superior Court. Court Reporter: Not Present. (gk) |
Filing 19 MINUTES OF Motion Hearing held before Judge Christina A. Snyder RE: Defendant's Motion to Dismiss 12 ; Defendant's Motion to Vacate Temporary Restraining Order 15 . The Court hereby GRANTS the government's motion to dismiss for lack of subject matter jurisdiction. Although the Court indicated at the hearing that it was prepared to vacate the Temporary Restraining Order issued by the Los Angeles County Superior Court, upon reflection, the Court finds that it lacks jurisdiction to do so.
