Snyder: IT IS HEREBY ORDERED, ADJUDGED AND DECREED that Defendant Scott Record and each of his agents, servants, employees, successors, assigns, attorneys, and any entity that Defendant has an ownershi p interest in (unless it is a publicly traded company), controls directly or indirectly or for which it/he is an officer, director, or provides advice or direction, and all those persons in active concert, or participation, or affiliated with one or more of the afore-described persons or under authority of Defendant who receive actual notice of this Order, shall to immediately cease and not resume making, contributing to the making, or inducing others to make any use of a name, trade name, trade mark, service mark, URL, domain name, or computer code which comprises or includes one or more of the Plaintiff's Trademarks, etc. The prevailing party in any proceeding to enforce the terms of this Permanent Injunction shall be entitled to recover the attorneys' fees and costs incurred therewith. Snyder: As to Defendant's Motion for Leave to Amend 50 , Defendant seeks to file an amended answer addressing two oversights in his operative answer. First, defendant's proposed amended answer as serts a new affirmative defensethat this Court may not exercise personal jurisdiction over him in California. Relatedly, defendant has filed a memorandum in support of his motion that explains his grounds for moving to dismiss for lack of personal ju risdiction, or in the alternative, to change venue. The Court construes this as a motion to dismiss for lack of subject matter jurisdiction or alternatively, to change venue. The Court concludes that it is not unreasonable to exercise personal jurisd iction over defendant in this case. The Court denies defendant's request to transfer this action to Idaho. The Court will allow the amended answer to be filed. The Court GRANTS plaintiff's motion for summary judgment as to defendant's liability on plaintiff's claims for relief and the Court awards plaintiff $2,000 in statutory damages 48 .
