Section 1125(a). JUDGMENT is hereby entered in this m atter in favor of counterclaimants Rodolfo Avila Sandoval and Los Altos Boots, Inc., and against counterclaim-defendant Reynaldo Hernandez, on counterclaimants' claims for common law trademark infringement and unfair competition under the laws o f the state of California. JUDGMENT is hereby entered in this matter in favor of counterclaimants Rodolfo Avila Sandoval and Los Altos Boots, Inc., and against counterclaim-defendant Reynaldo Hernandez, on counterclaimants' claims for unfair com petition pursuant to Cal. Bus. & Prof. Code Sections 17200 et seq. JUDGMENT is hereby entered in this matter in favor of counterclaimants Rodolfo Avila Sandoval and Los Altos Boots, Inc., and against counterclaim-defendant Reynaldo Hernandez, on coun terclaimants' claim for cancellation of trademark registration. Pursuant to 15 U.S.C. Section 1119, the Court directs the United States Patent and Trademark Office to cancel U.S. Registration No. 3,902,986. Counterclaim-defendant Reynaldo Hernandez is ORDERED to pay $32,477.00 in damages for his infringement of the ORIGINAL MICHEL trademarks. (MD JS-6, Case Terminated). (gk)

Snyder: On 12/5/2013, plaintiff filed a motion to suppress the deposition of Mario Cervantes Retamoza, a non-party, on the grounds that Retamoza failed to provide sufficient answers to several of plaintiff& #039;s questions during the deposition 53 . Defendants filed a request to have plaintiff refile his motion due to deficiencies in the joint stipulation. Defendants also request a continuance of the hearing date so that they may adequately respond to plaintiff's arguments, as well as an award of attorney's fees as a sanction for plaintiff's failure to comply with the requirements of Local Rule 37 55 . plaintiff's motion is DENIED without prejudice to being renewed if plainti ff obtains an order from the Magistrate Judge compelling Retamoza's testimony, and such order is not obeyed. The factual discovery cutoff, previously scheduled for 9/26/2013, is hereby extended to 2/18/2014, for the limited purpose of permitting plaintiff to bring a motion to compel before the Magistrate Judge. Defendants' request for attorney's fees is DENIED on the grounds that plaintiff is proceeding pro se, and may not be intimately familiar with the Local Rules and General Orders of this Court.
