Snyder: Upon Stipulation #131 , the Court hereby orders as follows: Philips' Second Cause of Action for Breach of Fiduciary Duty, Third Cause of Action for Fraudulent Transfer in Violation of California Civil Code section 3439 et seq., and Fourth Causes of Action for Violation of California Corporations Code sections 500 and 501 (Unlawful Dividend) are hereby dismissed without prejudice to Philips refiling those claims in the ISG Case (whereupon they shall be consolidated with the ISG and Freedman Cases). Philips' First Cause of Action for Breach of Contract in this action shall remain operative, but the stay entered on 4/14/2015 #126 shall remain in effect and the case shall remain removed from this Court's active caseload pursuant to the Court's 7/7/2015 order #128 . The parties shall file a joint status report detailing the status of the case every quarter following entry of this order until the action has been reactivated on this Court's active caseload or a further stipulation for dismissal is filed. Feess: At the September 23, 2013, conference in this case, the parties advised the Court, among other things, of the resolution of certain bankruptcy proceedings, the status of settlement negotiations with Beachbody, the potential impact of the settlement on the dispute between Phillips and the Crest defendants, and the possible amendment of the complaint. The Court indicated that it would issue a new scheduling and case management order shortly thereafter. However, the matter escaped the Court's further attention and through inadvertence no new order was issued. The Court apologizes for this oversight. Because of the passage of time and the number of pending items discussed at the status conference, the Court believes that it would be preferable to have the parties submit a new status report with current information regarding the Beachbody settlement, its impact on the remainder of the litigation, and a proposed new schedule for the Courts consideration. Accordingly, the parties are to meet and confer no later than December 27, 2013, for the purpose of discussing these matters, preparing a new joint status report, and a proposed new schedule.
