Because plaintiff's proposed new evidence cannot remedy the fundamental deficiency with his breach of contract claim, the Court also DENIES plaintiff's motions for leave to present a prerecorded statement by Ellen DeGeneres and an affirmation by nominor Gregory B. Given the fact that the statute of limitations has long since expired, it appears that there is no set of facts that plaintiff could allege to state a claim upon which relief could be granted.
