November 20, 2012 Opinion or Order Filing 32 MINUTE ORDER IN CHAMBERS by Judge Christina A. Snyder:ORDER DISMISSING CASE.On October 2, 2012, Chief Judge George H, King issued an order denying plaintiffs motion for emergency ex parte relief and ordering plaintiff to show cause why his complaint should not be dismissed with prejudice. Dkt. No. 11. In response to this order, plaintiff filed a First Amended Complaint reciting identical factual allegations and legal theories as set forth in hisoriginal Complaint, as well as the complaints he fi led in his previous federal court actions against the same or similar defendants. Plaintiff then filed a motion for preliminary injunctive relief, but did not in any other way respond to the Courts order to show cause 24 . Defendants then moved to di smiss on November 14, 2012 30 .Plaintiffs FAC is replete with details, but devoid of any plausible legal grounds for relief, and amending his complaint again would in no way cure this fundamental deficiency. Therefore, as with plaintiffs other compl aints alleging virtually identical facts, the Court finds that plaintiff cannot possibly cure the deficiencies in his FAC to state a plausible claim for relief here. In accordance with the foregoing, the Court hereby DISMISSES this case WITH PREJUDICE. (Made JS-6. Case Terminated.) (lc). Modified on 11/21/2012 (lc).
