MINUTES (IN CHAMBERS) by Judge Christina A. Snyder RE: Defendant's Motion to Dismiss Case 4 . Federal courts are courts of limited jurisdiction, having subject matter jurisdiction only over matters authorized by the Constitution and Congress. T he complaint alleges that the Protecting Tenants at Foreclosure Act ("PTFA"), Pub.L. No. 11122, Section 702, 123 Stat. 1632 (2009), provides plaintiff a federal private right of action and therefore raises a federal question. PTFA does not, however, create a federal private right of action. Therefore, it appears that this Court lacks federal question jurisdiction over the instant action. This case is dismissed. ( MD JS-6.
