Filing 116 ORDER re Stipulation to Dismiss Case 115 by Judge John A. Kronstadt: The Court, having considered the Stipulation of Dismissal filed by Plaintiff Virco Mfg. Corporation and Defendants Hertz Furniture Systems LLC and Academia Furniture LLC, a nd for good cause shown, hereby ORDERS that: 1. Pursuant to Rule 41(a)(1)(A)(ii) of the Federal Rules of Civil Procedure, all claims and defenses in this action are dismissed with prejudice; 2. The parties shall each bear their own costs, expenses, a nd attorneys fees; 3. The Courts grant of partial summary judgment of noninfringement of U.S. Design Patent No. D560,085, as set forth in Docket No. 89, entered on January 3, 2014, is hereby vacated; and, 4. The Court shall retain jurisdiction over the matter to enforce compliance with the Settlement Agreement. IT IS SO ORDERED. (Case Terminated. Made JS-6.) (kti) |
