Wilson: Plaintiff, a health care provider, alleges it has been harmed by the failure of the California Department of Health Care Services (DHCS) to process its claims for reimbursement under Medi-Cal for medical services that plaintiff performed in 2010 and 2011. Plaintiff blames the agency's inaction on a combination of acts and omissions allegedly committed by defendant Mary Hughes (Chief of DHCS's Provider Relations Oversight Unit) and defendant Xerox Business Services, LLC, which serves as a "fiscal intermediary" for DHCS processing Medi-Cal claims. Plaintiff contends that the defendants' behavior has caused its claims to remain in a bureaucratic limbo without eing approved or denies. For the foregoing reasons, the first amended complaint is hereby DISMISSED with leave to amend A second amended complaint, if any, shall be filed not later than Thursday, May 15, 2014. Failure to file an amended complaint by that date will result in dismissal of this action with prejudice. Defendant may file appropriate motions or amended answers no later than twenty-one days after the filing of a second amended complaint. (bp) |
