Kronstadt: In connection with Defendant's opposition to Plaintiff's Motion for Summary Judgment, he made evidentiary objections to the Receiver's Initial Report. Initial Report, Van Havermaat Decl., Dkt. 162-9, Ex. 5; see also Dkt. 151. These objections are premised on the failure to present with the Initial Report the documents which it claims to summarize. These documents are those of certain of the entities with which Defendant was associated that are now being overseen by the Receiver. Notwithstanding that the documents at issue are ones that were formerly in the custody or control of Defendant, these objections have merit. See Fed. R. Evid. 1006. Consequently, the ruling on the Motion for Summary Judgment is deferred. On or before June 8, 2015, Plaintiff shall produce to Defendant the documents that form the basis for the summary information presented in the Initial Report. If after reviewing such materials, Defendant contends that the summary information presented in the Initial Report does not accurately reflect the contents of these materials, then on or before June 18, 2015, Defendant shall file a supplemental brief limited to a discussion of that issue. Defendant shall attach a table to the supplemental brief in which the specific portion(s) of the Initial Report that he contests are identified by page number, with a citation to the corresponding underlying documents that Defendant contends were not accurately summarized on each such page. This brief itself shall not exceed five pages. Plaintiff may file a responsive brief, not to exceed five pages, on or before June 25, 2015. Plaintiff may also file a table that corresponds to one that is filed by Defendant. Upon receiving these supplemental filings the Court will evaluate them and then rule on the Motion for Summary Judgment.
