August 27, 2014 Opinion or Order Filing 45 ORDER DISMISSING CASE re: Stipulation for Dismissal of Entire Action with Prejudice by Judge Philip S. Gutierrez, 1. Plaintiff, SunTrust and U.S. Bank stipulate to immediately dismiss, with prejudice, the above-captioned action in its entirety as to all parties. 2. Defendant MTC FINANCIAL INC. DBA TRUSTEE CORPS ("Trustee Corps") was previously dismissed from this action on April 15, 2014. 3. Plaintiff, SunTrust and U.S. Bank stipulate that all parties are to bear their own attorneys� 39; fees and costs of suit herein. 4. Plaintiff, SunTrust and U.S. Bank further stipulate that they have entered into a settlement of the above-entitled action, which conditions dismissal of this action on the satisfactory completion of specified te rms that are to be performed by September 12, 2014. Accordingly, the parties respectfully request that this Court retain jurisdiction until September 12, 2014, to enforce the settlement between the parties. 5. Pursuant to Local Rule 5-4.3.4(a)(2)(i) , the ECF filer of this Stipulation, John Calvagna, attests that all other signatories listed below, and on whose behalf the filing is submitted, concur in the filing's content and have authorized the filing.
