Pursuant to 28 U.S.C. § 636, the Court has reviewed the Petition, the other records on file herein, and the Report and Recommendatio n of the United States Magistrate Judge. Further, the Court has engaged in a de novo review of those portions of the Report and Recommendation to which objections have been made. The Court accepts the findings and recommendation of the Magistrate Judge, except notes that the determinate portion of Petitioner's sentence was reduced, not the indeterminate portion. IT THEREFORE IS ORDERED that judgment be entered denying the Petition and dismissing this action with prejudice. (mp)

On June 5, 2014, Petitioner filed a Petition for Writ of Habeas Corpus pursuant to 28 U.S.C. § 2254. For the reasons discussed below, it appears the one-year statute of limitations has expired. The court, therefore, orders Petitioner to show cause on or before July 16, 2014, why the court should not recommend dismissal of the petition with prejudice based on expiration of the one-year statute of limitations.
