Filing 20 MINUTES (IN CHAMBERS): ORDER by Judge Percy Anderson: The Court is in receipt of the Motion to Strike Portions of Complaint, or in the alternative, to Dismiss All Individually Named Plaintiffs Except Jason Abner filed by defendant City of Los Angeles ("Defendant"). The Court is also in receipt of the Amended Response to the Court's Order to Show Cause regarding dismissal for improper joinder filed by plaintiff Jason Abner and 85 other plaintiffs (collectively "Plaintiffs"). (Docket No.16). Plaintiffs allege that Defendant violated the Fair Labor Standards Act ("FLSA"), 29 U.S.C. 201, et seq. Plaintiffs specifically allege that they did not receive overtime compensation for missed "Code 7" meal breaks, work they performed before after their scheduled shifts, and time spent on certain time-sensitive tasks. (Compl. 23.) Pursuant to Rule 78 of the Federal Rules of Civil Procedure and Local Rule 7-15, the Court finds that this matter is appropriate for decision without oral argument. The hearing calendared for October 20, 2014, is vacated, and the matter taken off calendar.Defendant's Motion is granted. Defendant's Motion to strike paragraphs five, sixteen, eighteen, and twenty-one from the Complaint is granted. The Court also drops all but the first named plaintiff from this action without prejudice. Thus, only Jason Abner's claim against Defendant remains in this action.
