Filing 22 ORDER by Judge Andre Birotte, Jr: granting 11 MOTION to Dismiss Case. The Court hereby GRANTS BANAs motion to dismiss. (Dkt. No. 18.) The third (breach of implied contract) and fifth (breach of implied covenant of good faith and fair dealing) cau ses of action are dismissed with prejudice. The first (intentional misrepresentation), second (negligent misrepresentation), and fourth (promissory estoppel) causes of action are dismissed with leave to amend.Plaintiff has 14 days from the date of th is Order to file an amended complaintwith respect to its first, second, and fourth causes of action. Failure to file an amended complaint by the deadline will render this Order a dismissal of the action with prejudice and full adjudication on the merits of Plaintiffs claims against BANA. The July 27, 2015 Scheduling Conference is hereby VACATED. The Courtwill re-set the Scheduling Conference if and when Plaintiff files an amendedcomplaint. (shb) |
