Filing 6 MINUTE ORDER (In Chambers): Order Remanding Action by Judge George H. King. On July 17, 2015, we ordered Defendant Thomas Kim dba Unimae ("Defendant") to show cause why this action should not be remanded because we lack subject matter j urisdiction. (Dkt. 5 ) We warned Defendant that the failure to timely and adequately show cause as required by our Order would be deemed an admission that remand is proper. Defendant's deadline to respond to our OSC has passed, and he has failed to respond. Accordingly, this action is hereby REMANDED to the state court from which it was removed. IT IS SO ORDERED. Filing 5 MINUTES (In Chambers): Order to Show Cause by Judge George H. King. The removing party bears the burden of establishing the existence of federal subject matter jurisdiction, and if there is any doubt as to whether removal was proper, remand is req uired. 28 U.S.C. § 1447(c); Duncan v. Stuetzie, 76 F.3d 1480, 1485 (9th Cir. 1996). Since no basis for federal question jurisdiction is evident based on the Complaint, Kim is hereby ORDERED TO SHOW CAUSE, in writing, within ten (10) days h ereof, why this matter should not be remanded because this Court lacks subject matter jurisdiction. Kim's failure to timely and adequately show cause as required herein shall be deemed Kim's admission that this Court lacks subject matter jurisdiction. In that event, this action shall be remanded. In light of this OSC, Plaintiff Youn Soon Sung's ("Plaintiff") Ex Parte Application to Remand Action to State Court, or In the Alternative, Shortening Time for A Motion to Remand is DENIED 4 as moot.
